Exemption: Content Produced by Third Parties

Referent to 18 U.S.C. § 2257, the operators of the website are neither the primary nor secondary "producers" of any material depicting real or simulated sexual conduct displayed hereon. Regarding such, the operators of hdblackporn.com restrict their actions to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is furnished by third-party users of the website. All content that is contributed by third-party users is presented on areas of hdblackporn.com which are under the control of third-party users. Hence, the website operators and owners are exempt from compliance with Section 2257 records keeping and labeling obligations as given in 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may take down any materials if such are judged, at the operator’s sole discretion, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.
